• You may not copy, modify, or distribute our platform or its components
• Our trademarks and branding may not be used without permission

6. AI-Generated Content

Our AI features generate assessments and other content based on your inputs:

• AI-generated content is provided "as-is" and should be reviewed before use
• You are responsible for verifying accuracy and appropriateness
• We do not guarantee AI outputs will be error-free or suitable for all purposes
• You retain ownership of AI-generated content created from your materials

7. Subscription and Payment

OutcomeView offers free and paid subscription tiers:

• Free Tier: Available for individual teachers with usage limits
• Paid Tiers: Billed monthly or annually as specified
• Prices may change with 30 days notice
• Refunds are handled on a case-by-case basis
• You may cancel at any time; access continues until the billing period ends

8. Privacy and Data

9. FERPA Compliance

10. Disclaimer of Warranties

OutcomeView is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, OutcomeView and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless OutcomeView, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time through Settings. Upon termination:

• Your right to use the service ceases immediately
• We may delete your data as described in our Privacy Policy
• Provisions that should survive termination will remain in effect

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
